"We held the auction on the basis of currently available realities. We have a valid instruction of arbitration manager, which prescribe us to carry out bidding, and we have no solution of Administration of Federal Antimonopoly Service (FAS) on actions concerning bidding for “Petersburg Tram Mechanical Plant”. With the absence of FAS solution we have no reason to change the bidding procedure. Immediately after the announcement of the resolution part of the FAS Administration decision RAD submitted a statement of claim on appeal against the non-statutory legal Act of Administration of FAS in St. Petersburg in accordance with Clause 52 of the Federal Law "On Protection of Competition", Clause 27 of Arbitration Procedure Code of the Russian Federation and the provisions of Chapter 24 of Arbitration Procedure Code of the Russian Federation. The adoption of this statement suspends execution of the instruction of the antimonopoly authority until the date when the arbitration court decision comes into force.

We are working on behalf of the creditor, in this case of North-West Bank of Sberbank of Russia, and we consider unacceptable the situation when unscrupulous interested parties impede the sale of debtors property and legal obtaining by the bank the funds received after selling of the mortgaged property. This practice goes back to the days of the black market of bankruptcies, when the troubled property was sold by gray schemes and when creditors had no legal mechanisms to return funds issued on loan and unpaid funds" (Andrey Stepanenko, General Director of the Auction House of the Russian Federation).
